As an internet service provider, we are entitled to claim immunity from copyright infringement claims under the DMCA’s “safe harbor” provisions.

Notice of Infringement – Claim

To submit a good faith copyright infringement claim, please provide the following details:

  • A physical or electronic signature of the copyright owner or an authorized representative;
  • Identification of the copyrighted work(s) claimed to have been infringed;
  • Identification of the infringing material, including its location on the Website (please provide a URL);
  • Contact information, including name, physical address, email, and phone number;
  • A statement affirming a good faith belief that the use of the material is unauthorized by the copyright owner, its agent, or the law;
  • A statement that the information provided is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Legal Consequences of False Claims

Title 17 USC §512(f) provides civil penalties, including attorney fees and damages, for individuals who knowingly misrepresent information in a DMCA notification.

By submitting a claim, you acknowledge and agree that we may share your identity and claim details with the alleged infringer.

Counter Notification – Restoration of Material

If you believe that material was removed in error, you may submit a counter-notice containing:

  • Your physical or electronic signature;
  • A description of the removed material and its original location before removal;
  • A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification;
  • Your name, address, phone number, and a statement consenting to the jurisdiction of the federal district court where your address is located (or any judicial district where the service provider operates, if outside the United States), agreeing to accept service of process from the original complainant.

Repeat Infringer Policy

We take copyright infringement seriously and maintain a record of DMCA notices. Users found to be repeat infringers may have their access restricted or accounts terminated.
