Legal Consequences of False Claims
Title 17 USC §512(f) provides civil penalties, including attorney fees and damages, for individuals who knowingly misrepresent information in a DMCA notification.

Counter Notification – Restoration of Material
If you believe that material was removed in error, you may submit a counter-notice containing:
- Your physical or electronic signature;
- A description of the removed material and its original location before removal;
- A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification;
- Your name, address, phone number, and a statement consenting to the jurisdiction of the federal district court where your address is located (or any judicial district where the service provider operates, if outside the United States), agreeing to accept service of process from the original complainant.
